upon the application for a new package goods store, wine and malt beverage license from, and if I butcher the name as I apologize, Osami Corporation doing business as Old Village convenience store, 2756 County Street, Somerset, Madison. Convenience store, 2756 County Street, Somerset, Massachusetts. Oh boy.

it does business So, Almside Corporation, as you said, it does business as Old Village Convenience Store here in Somerset at 2756 County Street. as Old Village Convenience.

So, the convenience store has been there for a long time. Vaisalbin has been working there since 2015. And just to try and generate a new income stream for the small business, they have been working on getting this beer and wine license approved. I know they worked with the town to help work on the legislation, which went to the state legislature and was passed a special legislation. We know it was passed a

special legislation, so this license is available under Chapter 86, Act of 2025. So, this license is available. So I know it's already been worked on at the state level and everything like that. Vaishal Bin is going to be the manager of record. She has experience working as a clerk at a liquor store. She's worked at Mendoza's Liquors in Dighton nearby, never had any

issues with violations or things like that. She's TIP certified, and she knows all the rules and regulations for serving alcohol. and yeah, we think this is going to be a really exciting opportunity for the store. They're very excited about it and ready to work with the town and everything, and all we're looking for today is just the town's approval of the new license, and then also of Vaisalben as the manager of

RECU. Okay, and so just for the people who might be watching at home, this originally dates back a few years, and I unfortunately don't recall the date, but the special legislation went to the state. Unfortunately, there was some paperwork date, but the special legislation went. issue, is my understanding, at the state level. Never got passed, so it never came back to the town of

Somerset, which is why a little less than a year ago, we re -petitioned the state after this went to, I believe, town meeting, right? Yes. Yep.

And, you know, now the state passed it, and so it's back to us. So the one question I would have is the hours of operation of the store exceed the hours of a typical liquor store, correct? Right. So how do we keep people from accessing the alcohol during the hours that we're not supposed to be selling alcohol? Right. I mean, I think part of that is definitely going to come down

to, like, I mean, I think part of that is definitely my shadow down is the manager and making sure all your employees are very aware of, like, what the hours are. Even if the store opens before 8 or stays open after 11, you know, you've got to make sure no one's selling after that. And then, you know, if the town wants to, you could work on, like, physical things, you know, for

closing. I don't know. That's not something anybody's planned on, but I'm sure they're willing to work with whatever the town requires for that type of situation. But, you know, I think the main thing would definitely be just making sure everybody knows people can't be. purchasing after those hours, making sure the hours are posted everywhere so the customers

know, hey, I can't be buying this before or after that time. So currently, what are the hours in the store? Right now, 6 to 10. 6 in the morning to 10. So they get 6 in the morning. To 8, yeah, with the time period. Yeah, so, and then Sunday, I think you can't sell after a certain time. Well, I think it's 11, well, I think it's 11 p.m. is like

the hour every day. On Sundays, it starts later. It's 8 a.m.

every other day, Monday through Saturday. Sunday, it can either start at 12 or 10, depending on what the town particularly allows. I'm not sure what Somerset's condition is. They'd obviously like it to start at 10 at Sunday, if that's allowable. And then, again, I think they're aware of the fact they can't be selling it before 8. they've got to be strict on that. Somebody comes in at 7.55. and tries to

buy a pack of beer, you know, you can't do that. That's going to be a violation. That's going to cause issues. Post the hours everywhere. Make sure all the employees, even besides Special Albin, are aware of these rules and aren't, you know, allowing anything to be done illegally. Yeah, I personally, I can't speak for the other members of the board, but I would like to see some type of physical barrier, whether

that's, you know, stanchions or, you know, posts. with rope on it that just, you know, really, you know, said the signal to the people, this section, with signage that says this section closed. I agree with Mr. Smith on that. That's definitely something I'd like to see because of their hours. Right, so the beer would be in like a separate cooler, right, from like where the soda is or whatever. So you

guys would be willing to have like a rope up or some sort of pallets, something that physically blocks it before 8 a.m. maybe a rope. I don't know if there's something you prefer or if there's a solution you guys think is most appropriate, but a rope or some sort of barrier that blocks it before 8 a.m.? Yeah, again, I've seen it. You can buy stanchions or you could just make your own posts with rope

on it. But I would want to see something so that, you know. at 10 a.m. when you're eligible to sell it, you know, somebody goes, moves those stanchions out of the way so people can access it. But it's clearly defined to the customer that, you know, this section is closed and the sign could say till 10 a.m. So you guys are willing to do that, right? And

just make sure, like, the employees know this is part of the routine every day.

You know, whoever's there in the morning, once it gets to 10 o 'clock, then you move it. Whoever is there to set up, if it wasn't... put up at night, make sure it's put up in the morning, that type of thing. Just build it into the routine of how the employees are going to work, and make sure you have it up and that it works with whatever you guys want. What are

they using for a register system over there as well? Vonsi, can you speak to the register system? Just a digital POS system. I would say so it's always updating whenever, but there is age verification on there. The other question would be just for the town, so we can make sure that liquor isn't being sold, or beer isn't being sold before the hours. Any way to ear tag

each beer item with alcohol? That way, if we had to come in and look at it, we can spot it on the receipts. Yeah, absolutely. Okay. And I think there might be a way to block out the sale of alcohol. That'd be great.

I can look into it. Selectman Costa comments. Yes, please. So I have two concerns.

First, first off, as you stated previous, Mr. Chairman, that this was approved by a previous board to go before town meeting for an exemption to the license limitation requirement. It was subsequently approved at town meeting. However, I have received several calls from other retailers in the area regarding the oversaturation of the market in town. It was subsequently approved at town meeting. There is a

liquor store, nearly, not actually, but nearly directly across the street in Indian Spring Plaza.

You go about three -quarters of a mile. down the road, there's another one, and maybe three -quarters of a mile down the road, there's another one there, as well as at least one other liquor store that's coming to mind in the south end of town. So that's my first concern, is, you know, should there be another license issued, and are we hurting previously established businesses by... allowing another

liquor license in town? And it's much more than beer and wine these days. You know, the malt beverage market has boomed. There are so many different products now available on the market that I think the potential that we could be doing this It's the potential that we could be doing a disservice to the liquor stores and proprietors that have been doing business in town in that market for a long time.

Secondly, I am aware, although there was never a public hearing held on it, because the proprietor decided not to appeal the infraction that there has been. an infraction of the tobacco sales and I apologize for not having the exact date I'm a little off kilter here because I am traveling not attending to a family matter but I do know for a fact that that was a recent matter and that there was no public hearing

on it because the proprietor just chose to there was no public hearing on it because

pay the fine so those are my two concerns and i am reticent to approve a license at this time so um is the owner of the old village convenience store the same owner as indian springs liquor No.

okay. All right. Yeah, I mean, I guess from my standpoint, and I certainly understand, you know, competitors potentially not wanting another location within the market. But, you know, I mean, this was something that this board voted on, maybe not this exact board, but the board of selectmen voted to send back up to the state.

board, but the board of selectmen voted. This is something that went before town meeting that the residents of town meeting voted to send back up to the state.

And, you know, I feel like, you know, I'm not looking to go against that vote of the body of the town meeting to say, well, no, no, I'm not going to approve it. even though the body at town meeting felt it was okay. So, so my concern is, is that, um, the, uh, concerns that were raised to me is that there, although it was a, uh, there was a public hearing held

on it. Um, you know, the other retailers weren't aware of it until after a fact, and as a matter of fact, weren't aware of it until it had gone to town meeting. I think, you know, again, I understand that another board approved it, but I'm going to stick to my guns and vote my conscience here. And, you know, it's not like, you know, we're selling autopods. It is an alcoholic beverage license. And

I think the town is. license um and i think the town is well served by the licenses that they have currently and uh you know it just leaves another option for a potential violation and given the fact that there have been violations on the tobacco side already here i'm not prepared to approve this can you extrapolate on the the violation on the tobacco yeah well

bonzi can you do you mind coming Tobacco. Yeah, well, Bonti, do you mind coming here for the tobacco thing? If I could just address the first point, though, as far as it comes to the public need and everything like that. I mean, first of all, I don't think public needs should come into play here where the license has already been approved by special legislation. It's not like a typical license where we're

looking for a license for our store and there's nothing allotted for that. This was already passed, as you said, by the town body and by the state for this particular store at this particular address, I know you made reference to Indian Spring Liquors, which is, you know, over half a mile or close to half a mile down the street. It's on the other side of the street. particular address. I know you

made reference to Indian spring liquors.

Not even close to a half a mile. Not even close. Was it a quarter mile? Yeah, maybe a little less. I would say it's less than a quarter of a mile. I didn't travel it out, to be perfectly honest with you, but it's less than a quarter of a mile. When I looked on Google Maps yesterday, I know it said at least, I'm sorry, I can't remember off the top of my

head, but at least like 0.2, but so whatever, it's around that range. It's on the other side of the street. So, you know, people traveling down one way would be more likely they'd want to go turn right into one shopping center. It's on the other side of the street, so, you know, people travel.

People traveling down the other side of the street are more likely to want to go right into the Indian liquor store. So it separates, you know, customers by that.

Secondly, that's a liquor store. We're talking about beer and wine for a convenience store.

So it's not necessarily going to be the same customer base. There's plenty of people that want to be able to buy beer and wine without having to go into a full liquor store and everything that that might entail, having to be put into that environment. Some people don't drink liquor because, you know. Some people don't drink liquor because it's too strong. And they may even have an issue with that. But a

beer or wine is fine for them. And so they can purchase beer and wine at the convenience store where they're already getting their convenience items without having to go into a liquor store. These people, they may have said whatever they said to you.

But I don't think that anybody is here to actually took the time to come to the meeting today to actually speak about any of this. So I can't, to me, it wouldn't seem that it's that important to them if they couldn't even appear publicly at the hearing. Secondly, I do think the state would wonder why they went through the effort of passing this legislation twice at the town. You say it was

a different board. I mean, you may not have been on the board, but it was the same board, the same town's board. I think the state would wonder, why did we go through this effort twice when the town told us it was OK, and then now they're going to turn around and not approve it. So again, I don't think the location is as big of an issue as you say, as far

as that liquor store across the street. I know you said there's other products that people use. that are sort of in between beer and wine. But when somebody wants their whiskey, somebody wants their vodka, these are loyal people that want their Tito's. They want their Jack Daniels. They're not going to buy some cut rate 22 % liquor.

It's not going to get the job done for them. So I don't think it's really as much of an issue as these people are making it sound to be.

As far as the tobacco license, is there one violation or two violations? One. So you said multiple violations. No, he said one. Well, at one point I did hear him use the plural. But so one violation, I mean, I understand violations are never something we want. First of all, this was for a tobacco license, not an alcohol license, so different there. But secondly, you have to stay on top of your employees

and make sure that no employee is thinking that they can skirt by. They've had this tobacco license for a long time. I don't know if you know which employee it was that sold it. But when this type of thing happens, you have to get on top of it, reprimand the employee, and make sure it's not going to happen again. But to some extent, you have young employees working there. Occasionally, an employee

makes a bad decision. Then as management, your job is to jump on top of those people. Yeah, go ahead. So this violation was, I believe, last fall. Around this time, we were actually going through a lot of employees, and a bunch of them are part time. And I believe one of them had forgotten the check for an ID. They've since been gone, but the last time that

we had a violation, I can't remember, 10, 15 years. They've since been gone. It's been a clean record before that. It sounds like you guys took full accountability for that fine. Yeah. We didn't fight it because we saw the videos, but we were at fault. And again, they take responsibility. The employee's gone. They make sure the rest of the employees know they can't do this. Use that as a learning point, and

it's one violation where they got a fine. We're not talking about a suspension of the license, a revocation of the license. or anything like that I mean just Or anything like that. fine right so so I mean the only thing I'm going to tell you I mean I'm in favor of proving this but you kind of lose me when you say well you know I mean turnover employees and you know training

and like look I mean it's pretty easy everybody gets carded you know I mean and again I mean as one member of this board I'm going to come down as hard as I possibly can on the first violation of somebody selling alcohol to somebody underage. of somebody selling alcohol to somebody So, you know, don't come up and start talking about, well, you know, young employees and they, no, I mean, I grew

up in that business. My dad managed Cumberland Farm Stores, 11 years old, I was ringing the cash register. It's not that hard. So, fair warning, you know, you come back before this board for a liquor violation, you know, it's going to be whatever the maximum the state allows me. Can you speak of a point? Because the former board passed this and the state passed

this, I'm willing to put this license out here for this company. I will, however, be looking for some stipulations on your POS, because you said your POS system is able to block out liquor sales at certain times. And Mr. Smith's point of having the barriers. I think that'd be a stipulation of us passing this. I agree.

So with that said, I'd be in favor of it with those stipulations. Okay. Anything else from the applicant? Just a good point that in the case that this has passed during the remodel, the age verification scanner is going to be activated.

Right now, because we have a lot older clientele, Right now, because we have a lot of older clientele. we don't have it on. But in the case of alcohol, it's going to be no sale without an ID scanned. I appreciate that. And I take the same stance as Mr. Smith on the violations. We don't need underage violations in this community. Would you like a motion, Mr. Smith? Hold on. Unless there's more

Okay, next item is application of brass meat market, 1118 County Street, Somerset, Massachusetts, for a convicular license for outdoor seating. It's their representative.

okay so you're looking to add outdoor seating yes correct for those who don't know me I'm Pedro Mendez the owner of process me market I want to thank the board to taking the time to hear me on so there's two reasons I'm applying I I want to add this to the business one is I have friends and people that can come to the store buy a snack or buy like a chicken croquet a I want

to be able to offer the clients like a place to sit down and eat it and also wanting improve the facade of the store the outside of the store so that's pretty I love the store. So that's pretty much it. I wanted only three tables, and that's it.

So, again, generally speaking, you know, we don't have a lot of outdoor seating. Subway, you know, Dunkin' Donuts, you know, they don't have outdoor seating. I mean, I can't imagine that the significant portion of your sales that are somebody that wants to purchase, you know, chicken croquet. or somebody that wants to purchase you know chicken croquet and be able to eat it there

no like it minimum honestly it's gonna help us um like even us that we like you're working over there we want to sit down outside it's i would say like five percent that the people that came in the company will feed outside yeah yeah i i mean i'm not a big fan of adding outdoor seating um you know again it's not you know you're not a deli you know where people are buying the food and

eating it i mean you know if you want to have a table you know you can make room inside the space to try to add a table where somebody can at a table where somebody can sit down but um you know the employees to take a break i mean sit down but um you know that's you know kind of something that you manage for your employees not necessarily yeah can i can

i ask the applicant how many menu items they have are prepared because my recollection is that there is not a lot of food there forgive me for not being a more frequent customer i have been there but my recollection is there is not a lot of prepared food there. We don't have a lot. We have probably like three items.

If you got this approval, would you increase your prepared food? Would you have more?

No, that's not the point. I mean, I'm always in favor of some outdoor seating for revitalizing downtown Somerset. i think it it adds to the appeal of downtown um there's some safety issues here I think it adds to the appeal of downtown. uh with with this proposal so i want to make sure we we capture those as well if we do approve it approve this um and also i believe there's a seating area

one store down from this as well so i mean we we this board even though i wasn't on the board approved seating for another another business next door and it'd be kind of shameful if we didn't if we didn't look into this into the be kind of shameful if we didn't if we didn't look into this into this situation as well um i think it'll it'll be good to see some

more foot traffic in that area for not only this business but other businesses as well so i'm i'm in i'm in support of this but we're gonna have to talk about if this is good if we get a motion we will have to talk about some safety concerns um because of the proximity to the street oh so let me let me ask is is there a kitchen in the building no i'm

sorry no no so there's no kitchen no so that's part of my other concern is that you know when the market closes that the mallard will just expand into that seating area um you know again the seating that was provided for that business was very limited in a very specified area um with you know safety as you know a significant part of the concern um mr mr chair if we if

we if we put a condition that they would have to put a physical gate and lock on this every night when they closed would that would that help you with this not really okay so do we do we have a recommendation from the building inspector has he looked at the plan so made a recommendation or anything so i will read from uh deputy chairman so I will read from Deputy Chief

Phillips as requested I've reviewed the submitted site plan and supplemental information for 118 a County Street the petitioner is seeking to create an outdoor dining area protected by barriers the proposed area is located on the west side of the building near the intersection of Pratt Avenue and runs the length of the business on County It runs the length of the business

on County Street side. Plans show vehicle impact protection on the west and north sides of the seating area. The plans indicate that the bollards allow for an unobstructed six -foot -wide access way to the front entrance slash exit of the store. The proposed site plan, as submitted, does not interfere with emergency egress and is acceptable as presented, provided the

following conditions are adhered to. acceptable as presented, provided the following conditions. The width of the entrance slash exit of the store and spacing in the barriers shall not change without approval of the Somerset Fire Department as they may hinder emergency access.

So I think the gate would be an issue for the fire department if a fire started after hours. The location of the table shall not obstruct access slash egress of the building. The seating area is protected on the west and north The seating area is protected. sides by vehicle impact protection.

Ballads are similar as shown on the submitted plans and any change or additions to the submitted plans such as tents, canopies, patio heaters, or outdoor cooking may require additional approval or permitting.

That's one. The second email is from James Aguiar, the building inspector. Please see the attached plan with notations. I concur with Deputy Chief's official correspondence letter is written. A recent site visit concluded that the vehicular barrier proposed for the northmost area of the outdoor seating has not been installed. I have included the attachment with reference to the barrier

area that remain missing as of yesterday, 6 -3 -2026. Due to the location of the premises adjacent to a numbered route containing high volumes of traffic, I feel that this missing section of vehicular barrier should be installed before the seating can be utilized. And that was from the building inspector. So that's the barriers alongside the building kind of across from my Rafa's okay

and currently you have you it looks like you have some that some barriers out there already but that's correct yeah and the seating is already out there I have a question about though I mean why is the seating out there already so is I didn't know so I saw the seating across the business I didn't know I had I need a license and go through the board and

for everything so I asked the bill the owner hey I just want to put the table and he thinks you know you need the you need the protection you need to do pretty much what I did so I'm searching it I I anticipate for myself that I needed to go through the board, and then I applied for a license, but I didn't know. That's why. So

the owner of the Mallard, who has outdoor seating, owns your building as well?

Yes. Okay.

So I'm not opposed out of hand. to the approval of the petition i would um

i mean i don't want to stand in the way of anybody making a living i think it's a little bit different in this case than it was with the liquor license liquor licenses are strictly controlled for a reason um i'm not going to revisit that controlled for a reason um i'm not gonna revisit that though but um i i would like if i would like to have the

final stamp of approval um of the building inspector um to make sure that you know everything is in place and all the the plans are finalized before we give the uh final okay on that so so so the only thing i would say is if the other members of the board are, you know, favorable to approving this, currently there are patio umbrellas on the table, which I would be very concerned

about having out there because it's on Route 138. And if, you know, those were to fly off during heavy winds or whatever, I mean, it could create, you know, a traffic accident. So if, you know, we're going to approve this, I would approve it without the Ambrose. So to Mr.

Smith's point, and Mr. Costa's point and my own points, there's a bunch of concerns here. However, there's some hope for this project. Would you guys be willing to table this to allow the building inspector to give us a favorable recommendation?

give us a favorable favorable recommendation. He did. Oh, I thought he, no, he just gave, yeah, so he, hold on. So he said, I concur with the deputy chief's official correspondence letter as written. favor of the second option um you know i'm not i i apologize i wasn't aware of this application um before um i left the area so i haven't been able to view it myself and look at it um as far as you know getting a at it as far as you know getting a lay of the land so to speak i know there is a residence directly behind the building so we're talking that the

speeding area would be on the north side of the building which is actually on pratt avenue directly across from my office so i you know i just like to be able to set eyes on it myself as well and uh you know do a little bit of follow -up i don't think there's any harm in tabling this um another week or two until

we are able to meet again there isn't even a kitchen there so i don't see any urgency behind this this request so and i think the other thing that i would like to see is uh a letter from your landlord it sounds like you've already discussed it with him but a letter from the landlord saying that he's in favor of the seating okay all right so

i think table and it's going to be for it's not a big big issue because again like you don't have a kitchen so it nobody's rushing to sit down as of right now but um i think if we could all come up with some conditions that we want and we can talk about those next meeting we can so i would say you know um you know i mean

if the other two members of the board I hate to have them install the rest of the barriers if this wasn't going to be approved. So, you know, if I am leaning towards approving it as long as there's no problems with a sidewalk. And like I said, I haven't been able to do this exactly myself. But as far as the sidewalk, as far as sight

lines for vehicles making right hand turns onto the. making right -hand turns onto the street from County Street and, you know, the ability to properly protect anybody that's sitting there as well. My main concern is, and again, if this is something that he wants to do to expand his business, you know, I wouldn't want to stand. I just don't want it to be

a hangout. I don't want it to be, you know, a place where, you know, somebody could go in, a kid could go in and buy a soda, and then, you know, everybody's sitting outside, you know, drinking the soda and hanging out there and potentially causing a problem. everybody would have to go in. Mine's more so the people from the Mallard are sitting out there drinking beers or, you know, any other alcohol.

That could potentially be a problem. Which is not, I see you're struggling with that.

The concern is once you leave the building and you're gone, nobody knows what happens on their property. the building and you're going you don't nobody knows what happens in on their property typically it's removable so if you guys want to plan out that we need to remove so every night you would bring in the seating i don't see what i don't see the problem okay we can we can table it and

then we can come back with some conditions i i just i've been in the construction business for a while and i just don't want to tell you to go ahead and do anything yet because what happens is you go we tell you we tell you yeah we want to do this so we want you to do that and then you do it and the condition comes up that yeah that hinders it

so let's You do that, and then you do it, and then a condition comes up that hinders it. So let's just table with a hold, and then we can come back and get you a real good plan. All right. I agree with Mr.

Bignaric as well. I would hate to give a conditional thing and that something that hadn't been considered is brought to somebody's attention, and then he's invested money into a project that we're not going to approve. So I would be in favor of, you know, I would agree with. would be in in favor of uh you know i would agree with mr bendaric w table it and we allow ourselves to
